My philosophy is to attempt a negotiated resolution, and to provide the client with a realistic assessment of the likely outcome should the matter proceed to court. I have often proceeded to court where required. The solution for success in court seems to be to be reasonable in the demands. Aggressiveness might impress some clients, it rarely impresses judges.
